1. Scope and coverage All services of the website are rendered on the basis of the following conditions. 2. Service Description The free services of the website cover the possibility of making texts, pictures, videos, GPS-Data and the like available. 3. Registration and Use By registering for use and/or adding content users acknowledge these terms of use as binding. 4. Contents The website saves pictuers, videos, GPS-data, texts and other information ("contents") for the user and merely arranges access respectively. Users are solely responsible for their created content. Users therefore assure that these do not violate the law, infringe ethical principles or third party rights (right to a name, personal rights, trademark rights, copyright, data protection, etc.). In particular, users commit themselves not to present pornographic, political, seditious content or content that glorifies violence, not to call for felonies or misdemeanour or present instructions to do so and not to offer services or let services be offered with such content. The same holds true for the sending of e-mails via the website. It is equally forbidden to post content insulting, defaming, molesting, infamising or harming other members and users in other form. Users are enjoined from spreading computer viruses, Trojan horses and other malicious programs via the website. At any time the provider is authorised to refuse acceptance of content, to delete content, to immediately delete the web pages and references directed towards them and to terminate the user’s membership. However, the provider does not assume a regular inspection duty. In the event of a violation of use (e.g. posting child pornography, depictions of violence, insults and the like) users are liable to the provider for all arising direct and indirect damages. Users indemnify the provider in the internal relationship from all third party claims resulting from violations. 5. Rights of Use By providing content the user agrees to these being published online via the platform. Users provide their content free of charge. In the event of the termination of membership, created and not deleted content remains published on the website. 7. Availability and Operability The provider is not obligated to ensure the availability and operability of the platform. 8. Infringement of Third Party Rights The provider does not assume liability for surveys published by users. The provider does not check the published content for possible infringements. All parties concerned commit themselves to replace an entirely or partially invalid or inexecutable provision with a valid provision that comes closest to the purpose of the invalid or inexecutable provision.
